Official Sweepstakes Rules
PRIZE AND VALUE:
One (1) Grand Prize will be awarded which consists of one each of the following products:

Winner may pick up gift basket prize between 4PM and 7PM on Thursday, August 28, 2008 at the Morgan Botanicals booth during Farmer's Market in Tehachapi, CA. If winner is unable to pick up the prize in person, winner must pay shipping for USPS delivery. Shipping charge varies depending on delivery destination.
Grand Prize has total Approximate Retail Value of $70.00 U.S.
Prizes may not be transferred or substituted, or exchanged for cash. Winners are solely responsible for all taxes associated with prize.
SWEEPSTAKES DATES:
Sweepstakes entries accepted starting May 29, 2008 and ends August 14, 2008 at 12:00 Noon PST. No entries accepted after this closing date.
METHOD OF ENTRY:
Enter online at morganbotanicals.com and follow the on-screen instructions to complete the entry form and submit an entry into the Sweepstakes. Required entry information is name, e-mail, and agree to sweepstakes rules.
Only one entry per person or household.
All entries become the property of Morgan Botanicals and will not be returned.
NO PURCHASE NECESSARY TO ENTER OR WIN:
No purchase or newsletter subscription is necessary to enter or win. Doing so will not increase your odds of winning.
ELIGIBILITY:
Entries are accepted from all locations, however if you unable to pick up the prize in person, you must pay for shipping.
You must be 18 years of age or older to enter sweepstakes.
Employees and their immediate families of Morgan Botanicals, their design firm, agencies or judges involved are not eligible to enter or win our sweepstakes.
ODDS:
Odds of winning depend upon the total number of eligible entries received.
WINNER SELECTION, NOTIFICATION AND ACKNOWLEDGMENT:
Winner will be selected on or about August 21, 2008 in a random drawing from all eligible entries received. Potential winner will be notified by e-mail, to the e-mail address given on the entry form. Potential winner must respond to e-mail notification within 3 days or prize winner will be disqualified, the prize will be forfeited, and an alternate potential winner may be selected by random drawing. In the event of non-compliance with these Official Rules, the prize will be forfeited and may be awarded to an alternate winner.
By accepting the prize, the winner acknowledges compliance with the Official Rules and agrees to accept the prize in the manner set forth by the Official Rules.
PUBLICITY:
Winner consents to the use of his/her name, community of residence, likeness, and/or biographical information on Morgan Botanicals website, in Morgan Botanicals e-mail newsletter, or otherwise used for advertising and promotional purposes, to notify the public of their winnings, in all media without limitation or additional compensation, except where prohibited by law.
RELEASE:
Winner agrees upon acceptance of prize to release Morgan Botanicals, their design firm, agencies or judges involved, including their owners, employees and immediate families from any and all liability and will be held harmless by winner and his/her heirs and executors for any injuries or damages of any kind sustained in connection with participation in this Sweepstakes or the use, acceptance, possession or awarding of any prize.
PRIVACY:
Personal information that you submit in this contest will be organized and stored only until the winner is selected, then deleted. Your personal information will never be sold or retained. E-mail address provided will only be used to notify potential winner(s).

WINNER LIST:
The sweepstakes winner list will be available on Morgan Botanicals website as soon as the winner is selected and notified, approximately August 28, 2008.
GENERAL CONDITIONS:
Sweepstakes is subject to all federal, state, provincial, and local laws and is void where prohibited by law.
Owners, employees and their immediate families of Morgan Botanicals, their design firm, agencies or judges involved are not responsible for technical, hardware, software, telephone or other communications malfunctions, errors or failures of any kind, lost or unavailable network connections, Web site, Internet, or ISP availability, unauthorized human intervention, traffic congestion, incomplete or inaccurate capture of entry information (regardless of cause) or failed, incomplete, garbled, jumbled or delayed computer transmissions which may limit one’s ability to enter the Sweepstakes, including any injury or damage to participant’s or any other person’s computer relating to or resulting from participating in this Sweepstakes.
ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE THE WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS IN VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING CRIMINAL PROSECUTION.
In the event there is a discrepancy or inconsistency between disclosures and other statements contained in any Sweepstakes materials and the terms and conditions of these Official Rules, these Official Rules shall prevail, govern, and control.
UNFORSEEN OCCURRENCES:
If, for any reason Sweepstakes cannot be conducted as planned by reason of computer virus, bugs, tampering, unauthorized intervention, fraud, errors, or any other causes beyond the control of Morgan Botanicals which, in the sole opinion of Morgan Botanicals, corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes as contemplated by these Official Rules, as determined by Morgan Botanicals in its sole discretion, Morgan Botanicals, may, without prior notice, terminate, modify or suspend the Sweepstakes, in whole or in part. In the event of termination of the Sweepstakes, Morgan Botanicals will post notice regarding the termination on their website and award the Sweepstakes prize in a random drawing from eligible entries received as of the time of termination.
DISPUTES:
Participant agrees that any and all disputes, claims, and causes of action arising out of or connected with the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court in the State of California. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, participants’ rights and obligations, or the rights and obligations of Morgan Botanicals in connection with the Sweepstakes, shall be governed by, and construed in accordance with federal law and to the extent not inconsistent, the laws of the State of California.
